Welcome to the Proform Equine website Terms and Conditions. Your use of this Website is governed by these Terms and Conditions set out below. By using any part of this Website, and/or placing an order on the Website you agree to be bound by the Terms and Conditions.
General
Proform Equine Ltd is the supplier of the goods and our address is Ashfields, Stoodleigh, Tiverton, Devon, EX16 9QF
By accessing this website, its search function and shop you are subject to the following terms and conditions, which may be modified at any time, without notice. It is your responsibility to ensure you are familiar with this document, and by ticking the box on the shopping basket page, you are verifying you understand this.
Our Contract (Order)
The information we seek from you when placing an order is for billing and delivery purposes or for contacting you if we have a query. When placing an order to purchase goods from Proform Equine, you will be sent an email confirming receipt of the order and the order details. A contract between you and Proform Equine will only take place once the order has been accepted, processed and items despatched, at which point your credit/debit card will be charged.
Pricing
All products offered for sale by Proform Equine are priced in Pounds Sterling and include UK VAT at the prevailing rate where applicable. Any customs or import duties due when your package reaches its destination country will be your responsibility. Occasionally, despite our best endeavours products appear mispriced, however we verify prices as part of our order confirmation email. If the correct price is lower than that promoted we will always charge you the lower amount and send you the product. If the correct price is higher, we will either contact you to advise you and request instructions before despatch or cancel the order and notify you accordingly.
Availability
We try to hold stocks of all styles for active products, however occasionally an item will be out of stock, if this is the case we will inform you. All delivery dates are estimates and are subject to availability. PLEASE NOTE: Our website is not stock controlled
Special Order Items
All items ordered specially such as those sourced outside our usual stock, those with personalisation or custom made i.e body protectors (538-0028) leather goods and imported goods are non-returnable. Cancellation must be made within a week of placing the order and this MUST be done by telephone on 01398 351 777
Payment
CREDIT or DEBIT CARD - The fastest way to pay for immediate despatch (stock dependant). We accept all major credit cards (excluding American express). Cards are not debited until goods are despatched.
CHEQUE - Please allow 10 working days for your payment to clear. Cheques should be made payable to Proform Equine.
GIFT VOUCHER - only accepted for post orders, we will require the unique voucher number and any additional payment if applicable. Vouchers can only be redeemed via post at our trade stand or at our showroom.
We accept online payments through a secure environment by credit or debit card and transactions are shown in Pounds Sterling. Do not email your card details. No responsibility can be taken for security if you provide your details in this way. Card fraud is illegal and will always lead to prosecution.
Intellectual Property
In no event are you permitted to publish, distribute or otherwise reproduce in any format any of the content or copies of the content supplied to you or which appears on the proformequine.co.uk and or proformequine.com sites.
Goods & Services
By ordering a product online, it is subject to availability and confirmation of the order price by us. Alternatives may be offered if an item is unavailable. Dispatch times may vary according to availability and are limited to mainland UK. We are not responsible for any delay in delivery occurring due to postal delays or force majeure. Proform Equine is entitled to refuse any request made by you. If your order is accepted we will inform you by emailing you or by phone call or text message. When shopping with Proform Equine you undertake that all details you provide to us requesting goods or services (or bids made at auction) are true and accurate, that you are an authorised user of the credit or debit card used to make your request or bid and that there are sufficient funds to cover the cost of the goods, services or bid. It is your responsibility to inform us of any changes to these details as soon as possible. All prices advertised are subject to change. You have the right to cancel your order in writing within 7 days (by post or email) and the goods must be returned at your own expense and in saleable condition.
Returns
If you return an item to us within 14 days in perfect condition, clean, and in new condition, complete with the original packaging, we will be happy to exchange or refund you with the original price. This does not affect your statutory rights.
Please note the following cannot be returned or exchanged unless faulty: Personalised and Special order items, DVD's, CD's, Videos, Underwear and Computer software. Personalised and Special order items cannot be cancelled once the order has been processed.
You must make your own arrangements to return goods to us and you will be responsible for the cost of return unless goods are faulty. We recommend that you obtain proof of postage as you are responsible for the returned goods until they arrive in our possession.

Hygiene Regulations
Due to the Health and Safety regulations and the hygienic problems involved with the inspection of Footwear and Horse Clothing, we are unable to handle and inspect any item unless it is clean and dry (Health and Safety at Work Act 1974)
Please note: For Hygiene reasons, Underwear is non-returnable.
Website Access
Your Shopping Account
When using the website, you are responsible for ensuring that your account details and passwords remain confidential and you agree to accept responsibility for all activities occurring under your account and password. If you believe this information has become known to someone else or that your account is being misused contact us immediately.
When registering your details ensure that the information you provide us with is complete and correct and that you advise us as soon as possible should this change or you wish your details removed.
Proform Equine reserves the right to edit or remove content, refuse access to the website or cancel orders at our discretion. If we cancel an order, it will be without charge to you and you will be notified immediately. Proform Equine does not charge for items until they are ready to despatch.
Please Note: We are unable to add or amend orders after you press the Order Now button.
You must not use the website in any way that causes, or is likely to cause the website or access to it to be interrupted, damaged or impaired in any way.
You must not use the website for fraudulent purposes, spamming or any unlawful activity.
Disclaimer - ownership of trade marks
Any trade marks/names as may be featured on the Proform Equine website are owned by the respective trade mark owners and Proform Equine claims no association, alliance or affiliation with them. Where a trade mark (brand name) is referred to it is used to describe or identify the products.
The contents of the website may not be copied, reproduced, duplicated, sold, downloaded or distributed by any means to third parties without our express written consent.
Liability
The information contained in the website is for information purposes. Proform Equine is not providing any recommendations or endorsements to any product or services promoted on the website. Maintenance
Our web development company may occasionally be required to carry out maintenance on our website and online shop which could result in short periods of unavailability. This is necessary sometimes in order to implement changes and upgrades. Every effort will be made to carry out these changes outside of the normal UK working hours of 9.30am to 5.30pm Monday to Friday.
Proform Equine have the right at its discretion at any time and without notice, to amend, remove or vary any of the content which appears on any page of the Proform Equine website.
Governing Law
